Affordable housing is lacking in Germany - by 2021 the federal government is planning a good 1.5 million new apartments to meet demand. The offer is not enough, especially in the cities. The problem of housing shortages is not new. As early as the 1950s, the first housing law required owners to provide a separate apartment in newly built single-family houses, i.e. an additional living area separate from the main apartment. This regulation has long been history, but the concept of a separate apartment still offers a number of advantages today.

Rent a separate apartment

Builders who plan their home with a separate apartment can either rent it or use it themselves. A rental creates additional living space and the rental income helps to finance the property. “The income from the rental can flow into the monthly repayment of the building loan,” explains Sven Schüler from LBS. “If you are considering buying an apartment as an investment anyway, a separate apartment is usually the cheaper alternative. A house with a separate apartment causes higher overall costs when it is built. In comparison, however, this is cheaper than buying an additional apartment separately.”Another advantage: unlike condominiums, you are the owner of a separate apartment directly on site. Family apartments are often also used by family members, for example when the children grow up and want their own area, or when it comes to having parents with them as they age. The granny flat also makes sense with regard to your own retirement provision: It offers space for household helpers or nursing staff. Sven Schüler: “For most people, their own four walls are a safeguard for later. It is therefore worth planning them in advance so that you can live in it yourself for as long as possible.”

Even if the granny flat is inhabited by relatives, the owners should conclude a lease. This is the only way that landlords can deduct maintenance costs. In order to take full advantage of the tax benefits, it is important that the rent is at least 66 percent of the usual local level.

What is a separate apartment?

Paragraph eleven of the second Housing Act means that a granny flat is a second flat contained in a home that is of minor importance compared to the main flat. As a rule, it is structurally separated from the main apartment, i.e. it is completed, but theoretically it cannot be planned to be completed. It is important that independent household management is possible. So there must be a bathroom and cooking facilities. In addition, landlords should inform themselves about any regional building regulations that they must take into account when planning. The term granny flat was originally derived from agricultural workers who rented accommodation from the farmers for whom they worked. They were called gritters.

What is important when it comes to financing?

The same principle applies to houses with separate apartments as to other real estate financing: The key is a solid and at the same time affordable financing mix of equity, classic annuity loan and home savings contract. It makes sense to plan two separate financings for the separate apartment and the self-used unit, because interest on debt or maintenance costs of the rental unit can be tax deductible. Due to the separate financing, these expenses can be clearly allocated to the units. It is also important to allow for any loss of rent when repaying the loan and to choose the monthly installments so that they can be paid without the income from the apartment.

Are granny flats specially funded?

Houses with separate apartments have some special features in terms of eligibility. KfW loans, for example, are granted per residential unit, so that a house with a separate apartment can be funded twice. However, according to paragraph 92a of the Income Tax Act, support from residential Riester is only possible for owner-occupied apartments. This means that rented apartments are excluded. Instead, the construction child allowance can be used, taking into account the funding requirements for the dream of owning a home - regardless of whether the separate apartment is rented. Because there is a subsidy of 12, 000 euros per child in ten years. It is only important that the owners are registered in the main apartment with their main residence.

Are tax aspects to be considered?

Owners can claim expenses for a rented apartment. This includes, for example, costs for maintenance work and repairs, for garden maintenance, but also for loan interest or the broker if a new lease is necessary. Anyone who makes a profit by renting a separate apartment must of course also tax it.
