Among other things, the regulations for border development regulate how close you can build to your own property boundary - and thus how close your neighbor can get to you. What is border development?

When building a house, you have unexpected questions, such as how close you can build to the property line - how close you can be to your neighbors. What may limit you in extreme cases can also be a blessing in other cases. Because your neighbor must also adhere to these rules for border development. For example, a meter-high garden wall directly in front of your window must not be.

When does one speak of border development?

The regulations for border development regulate the question of how close the neighbor may be to the property boundary and thus also to your property. On the one hand, they serve neighborhood peace and privacy, but on the other hand they also serve to protect people against fire and improve living quality. Border development is not uniformly regulated throughout Germany - in other words, not only do different regulations apply depending on the federal state, the building authorities can even override the regulations in certain cases.

How much distance must there be from your neighbor?

Even if each federal state has its own building regulations, the regulations on border development are quite similar in content. The following rules for the clearance area can therefore be roughly stated:

  • The distance area is calculated from the building height, multiplied by a value between 0.25 and 1 (depending on the state).
  • The defined distance surface always extends across the entire width of the facade. This means that the spacing area must be maintained over the entire width.

The question of how much distance the neighbor has to you or you have to keep from the neighbor is answered in most cases with 2.5 to 3 meters. And: Most countries have set a minimum distance, which must always be observed when in doubt. This is usually three meters. If the calculated value is below this, the three meters must still be observed. If the value is higher, the higher number applies. Three meters sounds a little, but when in doubt it is quite a lot, especially if it is "only" a wooden or metal garden fence or a garage.

What are the exact regulations for border development?

But don't worry, this is where the building authorities differentiate between the different structures. The border development provides for this in detail:

  • Garage and carport: Whether garage or carport, the clearance areas are not relevant here. Provided that they do not exceed the dimensions of nine by three (length by width) meters.
  • Garden shed: The same rules apply to garden sheds and greenhouses as to garages and carports.
  • Fence and wall: Basically, the property owner can choose the pacification (ie the "fencing") of his property himself. So whether you build a quarry stone wall or a high garden fence is up to you. In most federal states, however, the construction of a fence or wall between two properties is limited to one and a half meters.

Whether you delimit your property with a fence or a wall is up to you. However, pay attention to the height and the distance to the neighboring property as well as the regulations for border development.

Border development: when do you need the consent of your neighbors?

If you, as the property owner, adhere to the regulations of the building code regarding border development, you do not need to obtain a declaration of consent from your neighbors. However, if you want to be a good neighbor, inform the neighbors who are directly affected about your project in advance. In this way disputes can be avoided.

Are there any exceptions to border development?

If, for certain reasons, you want to build something with less space, the neighbors can give their consent - this simplifies the building permit. This declaration of consent must then be made officially and is recorded in the land register by the building authority.

There is also the option of not only maintaining the distance on your property, but also using the space of your neighbor. In this case, a declaration of consent from the neighbors must also be obtained, which must then be entered in the land register. In addition, the neighbor will no longer be able to build on this area of ​​his property in the future.

The development plan regulates the border distances

If there is a development plan for your residential area, it also defines the rules for border development. A so-called construction window is usually defined for the main and outbuildings on each property - this is the term for the buildable area that the buildings must not exceed.

How far you can - or even have to - move your house to the property boundary also depends on whether it is a so-called open or closed development. Closed means that the houses must be built wall by wall directly on the border. This is the rule in row house settlements and in densely built-up cities and town centers, so that the space can be optimally used. If a closed development is required, you are therefore obliged to plan your building so that it borders directly on the neighboring building or exactly with the property boundary.

Objection to border development: the possibilities

Do you suspect that your neighbor violated the clearance area and built it too close or illegally? Then you should first contact the neighbor and start the conversation. If this does not help, you can contact the building authorities and arrange for an exact measurement. If the neighbor does not react to this, in extreme cases only a lawyer can help. There is a possibility that the existing structure will have to be torn down again.
