Telesales subcontractors offering services is something common that we have all suffered on occasion. The problem arises when we have expressly requested that we not be included in this type of calls, and we continue to receive them. In this case, it is two fines of 30,000 euros to two companies subcontracted by Orange for calling different telephone numbers offering Jazztel services. Many of these calls were directed at customers who had already requested to be excluded from this type of harassing calls .
Therefore, one of these clients decided to denounce Jazztel in October 2015, alleging that they could not receive harassing telephone calls, as they were registered on the Robinson List, which excludes users who join the same from receiving calls of a commercial nature from telemarketers, considering them as harassment telephone .
But, despite this client being on the list, he received what he considered to be harassing telephone calls from the company Global Telemarketing, one of the companies subcontracted by Orange, which was formerly known as Jazztel .
Despite Global Telemarketing's allegations that the client had requested information via the Internet, these were dismissed by the AEPD, because the documents presented were limited to a screenshot of a computer system .
All this is without there being true proof that this capture indicated that it was that client who made that query.
The other of the two fined companies, called Crosseling Operators 3.9. SLU, is similar to the first, but this time the fine does not fall on Jazztel, this company being exonerated from responsibility as it is one of the subcontracted companies of another company that in turn was a of the companies subcontracted by Orange .
